President Bill Clinton signed the Family and Medical Leave Act into law in 1993. It entitles eligible employees to take an unpaid leave from their jobs for certain family and medical reasons. While away from the job, the person with group health insurance with their company will not experience any interruption in their coverage. Employees can take up to twelve weeks of unpaid leave to receive medical treatment. The twelve weeks must take place during a one-year period.
When the person returns to work, the law guarantees that their job or an equivalent one will be waiting for them. FMLA for rehab helps people get the valuable help they need without worrying that their jobs won’t remain open to them upon their return.
FMLA covers more than just a need to step away from work for medical treatment. It can also be used to provide needed care for a family member, including a child, parent, or spouse. As well, it covers taking a leave because of the birth or adoption of a child. Finally, someone who needs to take time off for military-related reasons related to the employee’s spouse, child, or parent, can do so under the FMLA. The employer may request a reason for the leave or certification provided by a health care provider that supports the need for taking a break. The employer must give the employee at least 15 calendar days to produce the certification. However, the employer is not entitled to review the individual’s medical records.
